第一章 总 则
第一条 为维护建筑施工现场的正常秩序,提高文明施工水平,确保施工安全和工程质量,根据有关法律和《四川省建筑管理条例》,结合成都市实际,制定本规定。
第二条 本规定所称建筑施工现场,是指经省、市、区(市)县人民政府有关部门批准,进行新建、扩建、改建的工业和民用建筑项目、建筑装饰装修等施工活动的场地。
第三条 在本市行政区域内的建筑施工现场从事建筑施工活动的单位和个人必须遵守本规定。
第四条 成都市建筑业管理局负责本市建筑施工现场的统一监督管理。各区(市)县建委依照职权负责本辖区内建筑施工现场的监督管理,并接受市建筑业管理局的业务指导和监督检查。
市、区(市)县政府的有关管理部门。应按职责协同市建筑业管理局、区(市)县建委实施建筑施工现场的各项监督管理。
第五条 在建筑施工现场各项管理工作中做出显著成绩的单位和个人、应给予表彰、奖励。
第二章 施工管理
第六条 建筑施工现场实行施工组织管理、工程质量管理、施工安全管理、文明施工管理和建设(监理)单位现场管理业绩综合考评。综合考评的结果应定期公布并作为企业资质等级升、降级和资质年审的考核条件之一。
第七条 建设、监理和施工单位必须在资质证书许可的范围内从事建筑活动。施工单位应按有关规定取得安全认证,其专业管理人员和技术工人应按规定取得岗位证书,并做到持证上岗。
第八条 建设单位应当依法办理《建设工程施工许可证》后,方可施工。
第九条 施工单位必须按有关规定到市建筑业管理局或区(市)县建委办理建筑施工现场《文明施工责任书》。
禁止夜间进行产生环境噪声污染的建筑施工。因抢修、抢险作业和因生产工艺上要求或者特殊需要必须连续作业,确需进行夜间施工的,必须办理《夜间施工许可证》,并公告附近居民。
第十条 施工单位必须编制建筑工程施工组织设计。建筑工程实行总包和分包的,总包单位负责编制建筑工程施工组织设计,分包单位编制分包工程的施工方案。
第十一条 建设单位应向施工单位提供与建筑施工现场相关的地下管线资料,施工单位应当采取措施加以保护。
第十二条 施工单位应当在批准的建筑施工现场范围内组织施工:
(一)在施工现场周边设立围护设施,临街和居民居住区的施工现场,应当设置封闭式围护设施和警示标志,保持施工现场周边安全、整洁、畅通;
(二)在施工现场明显部位设置施工公告牌、工程概况牌、施工进度牌、安全纪律牌、施工总平面布置图;
(三)施工现场的管理人员和技术工人应当佩戴证明其身份的证卡;
(四)施工单位应当按照施工总平面布置图设置临时设施、机具设备、堆放建筑材料,保证出入口道路及场内通畅、整洁。
第十三条 建设、监理和施工单位应当加强质量管理,建立健全质量管理和保证体系,全面落实质量责任制,确保工程质量。
进入建筑施工现场的建筑材料、设备、建筑构配件、商品混凝土、建筑制品和建筑装饰装修材料,必须符合国家、行业规定的质量标准。
第十四条 建筑施工现场的安全由施工单位负责。施工单位必须按规定办理建筑施工现场安全监督手续。严禁违章指挥、违章作业。
发生安全事故,应当依照有关法律、法规的规定报告和处理。
第十五条 施工单位应当按照国家消防法规规定,在建筑施工现场配备符合规范的消防设施,并保持完好的备用状态。
贮存、使用易燃、易爆化学物品或材料时,施工单位必须执行国家有关安全管理规定,并采取相应的消防措施。
进行爆破作业时,必须遵守爆破作业规程。
第十六条 施工单位需要招用外来务工劳动者的,应按照有关规定办理《用工证》、《外来人员就业证》后,方可进入施工现场工作。
第十七条 有下列情形之—的,建设单位应依法到有关部门办理申报批准手续:
(一)临时占用规划批准范围以外场地的;
(二)损坏道路,移动管线、电力、通讯等公共设施及砍伐树木、迁移古树名木的;
(三)发现地下文物的;
(四)临时停水、停气、停电、中断交通的;
(五)进行爆破作业的;
(六)迁建水文、测绘标志的;
(七)法律法规规定的其他需要办理报批手续的。
经批准后的(四)、(五)两项应提前向附近居民公告。
第三章 卫生管理
第十八条 施工单位必须建立健全建筑施工现场卫生制度,落实各项卫生防病措施,开展爱国卫生活动,加强建筑施工现场除四害及消毒工作。
第十九条 建筑施工现场的生活饮用水必须符合有关法律、法规规定的标准,人员居住地卫生条件、卫生设施应符合有关规定。
第二十条 建筑施工现场职工食堂的卫生必须达到有关食品卫生法律、法规规定的标准,并按规定申请办理《卫生许可证》。食堂工作人员应经健康检查,取得《健康证》后方可上岗。
第四章 环境管理
第二十—条 建筑施工现场禁止下列行为:
(一)高空抛撤废物;
(二)将有毒有害废物作土方回填;
(三)泥浆水未经处理直接排入城市排水设施或河道;
(四)无符合规定装置而在施工现场熔融沥青或者焚烧油毡、油漆以及其它产生有毒有害烟尘和恶臭气体的物质。
第二十二条 建设、施工单位应采取有效措施控制施工过程中的扬尘、噪声和震动,防治污染和危害。
第二十三条 施工单位应按有关规定运输建筑材料、处置建筑渣土和各种废物。
第五章 治安管理
第二十四条 施工单位必须加强建筑施工观场的社会治安综合治理工作,落实社会治安综合治理工作责任制。
建设单位应协助施工单位加强建筑施工现场的社会治安综合治理工作。
第二十五条 施工单位负责建筑施工现场社会治安综合治理工作:
(一)建立健全社会治安综合治理的责任制度,并按规定签订《社会治安综合治理责任书》;
(二)建筑施工现场发生治安事件时,必须报告所在地公安机关,并协助公安机关执行公务。
第二十六条 劳务输出单位应向用工单位提供务工劳动者的基本情况,并协助用工单位对务工劳动者进行管理。劳务用工单位,应对其务工劳动者进行文明施工、安全生产和法制教育。
第六章 法律责任
第二十七条 施工单位违反本规定,有下列行为之—的,责令改正,视其情节给予警告、停止施工,并可处以一千以上五千元以下罚款:
(一)未办理《文明施工责任书》或应办理而未办理《夜间施工许可证》的;
(二)违反第十四条规定的;
(三)未采取有效措施控制扬尘、噪声、震动污染和危害的;
(四)违反第二十一条规定之一的;
(五)未按规定编制建筑工程施工组织设计的;
(六)违反第十二条(一)、(二)、(四)项规定之一的;
(七)违反第十一条规定,对建设单位提供的地下管线未采取措施加以保护的。
第二十八条 施工单位违反本规定,有下列行为之一的。责令改正、视其情节给予警告、没收违法所得、停止施工、停止六个月至十二个月的投标资格、降低资质等级或吊销资质证书,并可处以工程造价的千分之一至千分之五的罚款:
(—)未按规定在资质证书许可的范围内从事建筑施工活动的;
(二)施工单位观场管理业绩,经综合考评为不合格的;
(三)工程建设未实行质量责任制造成质量隐患或事故的;使用不符合国家、行业规定的质量标准的建筑材料、设备、建筑构配件、商品混凝土、建筑装饰装修材料的。
第二十九条 建设单位违反本规定,有下列行为之一的,视其情节给予警告、责令停止施工,并可处以工程总造价千分之一至千分之三的罚款:
(一)建设单位现场管理业绩,经综合考评为不合格的;
(二)建设单位未向施工单位提供地下管线资料造成后果的;
(三)对施工现场未采取有效措施防治危害的。
第三十条 监理单位违反本规定,有下列行为之一的、责令改正,视其情节给予警告,并可处以一千元以上二万元以下的罚款:
(一)监理单位现场管理业绩。经综合考评为不合格的;
(二)未在资质证书许可的范围内从事工程建设监理的。
第三十一条 违反本规定的行政处罚由市建筑业管理局、区(市)县建委实施。
建设、监理、和施工单位违反本规定同时又违反其他有关法律、法规规定的,由市、区(市)县政府有关管理部门,依法实施行政处罚。
第三十二条 对当事人的同一个违法行为,不得给予两次以上罚款的行政处罚。
第三十三条 从事建筑活动的单位和个人违反本规定、造成他人财产损失或人身伤亡事故的,应依法赔偿损失;构成犯罪的,依法追究刑事责任。
第二十四条 建筑施工现场监督管理部门的工作人员徇私舞弊、贪赃枉法的,由所在单位或有关主管部门给予行政处分;构成犯罪的,依法追究刑事责任。
第三十五条 当事人对行政处罚决定不服的,可依法申请行政复议或提起行政诉讼。
第七章 附 则
第三十六条 本规定具体应用中的问题,由成都市人民政府负责解释。
第三十七条 本规定自公布之日起施行。
本市人民政府过去制定的有关施工现场管理规定与本规定不一致的,遵照本规定。

PART I PRELIMINARY

Ordinance may be cited as the Trade Descriptions Ordinance.
nterpretation.
In this Ordinance, unless the context otherwise requires--
ertisement" includes a catalogue, a circular and a price list;

a trade mark relating to goods registered in Hong Kong under the
Trade

a trade mark registered in the register of trade marks kept under

a trade mark--
registered, or in respect of which an application for
registration has
made, in a British territory or a Convention country; and
capable of registration in Hong Kong under the Trade Marks
Ordinance

(a) For the purposes of this Ordinance, goods shall be deemed to
have

manufactured in the country in which they last underwent a

Where an order under this section is in force with respect to goods

description, any person who, in the course of any trade or

order commits an offence.
An order under this section may make different provision for

umstances and may, in the case of goods supplied in
circumstances
e the information or instruction required by the order would
not be
eyed until after delivery, required the whole or part thereof
to be
displayed near the goods.

PART II FALSE TRADE DESCRIPTIONS OR REPRESENTATIONS AND
FORGED TRADE MARKS

falsely applies to any goods any trade mark or any mark so

disposes of or has in his possession any die, block, machine or

commits an offence unless he proves that he acted without intent

Subject to the provisions of this Ordinance, any person who

For the purposes of this section, a person shall be deemed--

without the assent of the proprietor of the trade mark, makes

falsifies any genuine trade mark, whether by alteration,
addition,
cement or otherwise;
falsely to apply to goods a trade mark who without the assent of
